In New York State, both Federal and State laws govern the practice of Arbitration in civil cases. Specifically, this training will address the practice of Arbitration in Civil cases, including those referred from the City, Town, and Village Small Claims Courts. It will include both theory and practice, with ample opportunity to discuss topics with the trainers.
Participants in this training are not required to be attorneys, paralegals, or have other educational qualifications (though a basic working knowledge of the courts is certainly helpful). The context will be the use of Arbitration as Alternative Dispute Resolution, in cooperation with other practices such as Mediation, Conciliation, Conflict Coaching, and Restorative Practices.
Day One and Day Two will focus on the theory and practice of Arbitration, and will be delivered by Stephen P. LaLonde. Mr. LaLonde provides arbitration, ADR Consultation, fact finding and dispute resolution services to public and private sectors. Practice areas include labor-management, commercial, securities and other arenas. Through NYSDRA, he has provided Lemon Law training to Arbitrators practicing at Community Dispute Resolution Centers for years, and has previously provided Arbitrator training for The Peacemaker Program.
Day Three will focus on how Arbitration interacts with other forms of Dispute Resolution, how to successfully manage a Med-Arb program, and additional practice and role-play opportunities. It will be delivered by Mark W. Leuthauser, the Director of Training and Programs at Empowered Pathways. Mark has been an Arbitrator for over a decade, as well as a Mediator, Facilitator, Conflict Coach, Circle Keeper, and Trainer.
